Residential Sideyard Requirements 

It is necessary to pay special attention to the requirements in the 2005 National Building Code on spatial separations. While the zoning bylaw may allow 750mm (2½ foot) side yards, the 2005 National Building Code is more restrictive. As a general guideline the following should be noted for new construction.

One Unit Dwellings:

  1. Where a portion of a wall extends to less than 600mm (2 feet) from the property line, that portion of the wall must have non-combustible cladding.
  2. Glazed openings are not permitted to face a property line where the glazed opening is less than 1.2m (4 feet) from a property line unless the property line is adjacent to a public way. (Note: The limiting distance is permitted to be measured perpendicular to the glazed opening where the glazed opening is at an angle to the property line.)
  3. Walls less than 1.2m (4 feet) from the property line require a ¾ hr fire resistance rating. If any portion of the wall requires the ¾ hr rating, the entire wall shall be rated unless a summary of how the spatial separation requirements are met is provided. (5/8" fireguard drywall, or ½" fireguard drywall with rock wool insulation.)
  4. Table 9.10.14.1 specifies the permitted glazed openings in a wall. As an example:
    • 7% glazed openings is permitted for a wall with an exposing building face area of 30m2 that is 1.2m from the property line.
    • 9% glazed openings is permitted for a wall with an exposing building face area of 30m2 that is 1.5m from the property line.
  5. Where the total window area in an elevation exceeds the percent permitted of the wall area (excluding attic spaces), as per table 9.10.14.1 or 3.2.3.1.A, you must submit a summary of how you met the spatial separation requirements.

The above requirement does not eliminate or reduce the requirements for windows in bedrooms and living spaces so attention to your layout must be provided in designing your home. Where an exterior wall of a building is facing a public way the distances may be measured to the center of the public way.
