Court dismisses injunction for Briarwood home demolition & encourages parties to talk
Mr. Justice R.W. Elson today ruled on the application of the owner of 166 Beechdale Crescent for an injunction to prevent the demolition of his property.
An injunction was not granted by the Court.
The City can proceed to demolish the property. However, the Court’s decision does not guarantee that the property will be demolished.
Demolition will depend on whether a plan can be formulated with the City to determine if the property can be remediated safely, legally and quickly.
If the City will be proceeding to demolition, further notice will be provided to the surrounding residents before demolition commences.
