Discretionary Use Proposal

Following feedback received through engagement, the applicants have reduced their proposal to a Day Care Centre with a capacity of 45 persons under supervision and 10 staff for the subject site.

Roots of Learning has applied for Discretionary Use approval to operate a Day Care at 190 and 194 Mazurek Cres in the Rosewood neighbourhood.

This site is zoned R2 - Low Density Residential District 2 under the Zoning Bylaw. The purpose of the R2 District is to provide for residential development in the form of one- to four-unit dwellings as well as related community uses. Day Cares are listed as a discretionary use in the R2 District.

Subject to discretionary Use approval, the proposed Day Care will have a capacity for up to 45 persons under supervision and 10 employees at any given time. 

Day cares must provide at least 7m² of outdoor play space for each person under the age of 13. At least 3.5m² per person must be located on-site and fenced. The remaining area can be located at a nearby location provided they obtain Ministry of Education approval. The revised application is proposing to provide approximately 252m² of outdoor play area which will be located on site. Approval from the Ministry of Education has been received to use nearby parks to supplement the remaining requirement.

The parking and loading needs will be assessed through the review of the Discretionary Use. A minimum number of spaces may be required based on the parking plan, location, and other relevant factors like the number of employees or expected visitors. The revised proposal will provide for 9 parking spaces to be located on site which will be accessed from Rosewood Dr., 1 of which will be tandem.

Prior to operating, the applicant will be required to obtain appropriate licensing and approval from the Ministry of Education, Early Years and Childcare Branch.

What is a Discretionary Use?

All property in the City of Saskatoon is assigned a zoning designation. Within each zoning designation, specific land uses are either permitted, prohibited, or discretionary. A Discretionary Use is a land use that is generally consistent with the permitted uses in a zoning district. As per Section 4.7.2 of the Zoning Bylaw, a Discretionary Use may be allowed either at the discretion of City Council or City Administration. Either approving authority can approve, approve with conditions, or deny a Discretionary Use application. The approving authority for a day care in the R2 District is City Council.

The Planning and Development Department evaluates Discretionary Use applications on a case-by-case basis considering the site itself, as well as the surrounding context including nearby land uses. A Discretionary Use approval is applied to a specific site, not the applicant. Any change in size or intensity of the use approved would require a new Discretionary Use application.

What is a Day Care?

The Zoning Bylaw defines a Day Care as an establishment providing for the care, supervision, protection, or support of individuals of any age who require care or support on a regular, periodic, or temporary basis, and includes child care centres as defined by The Child Care Act, 2014, but does not include the provision of overnight supervision.

Process for Reviewing and Approving a Discretionary Use Application

When a Discretionary Use application is received by the Planning and Development Department, it is circulated to internal Civic Departments to identify conformance or conflict with the Official Community Plan, the Zoning Bylaw, and any other applicable policies and regulations.  Departments that review the application include Planning and Development, Transportation & Construction, Environment & Utilities, Fire & Protective Services, and Building Standards.

Once the application has been reviewed by internal Civic Departments, public consultation on the application is undertaken.  Registered property owners typically within 150 metres of the subject site and the Ward Councillor are notified of the proposed Discretionary Use application as per the City’s Public Notice Policy.  When considered necessary, a public information meeting may be held to provide information to area residents on the Discretionary Use application, answer questions, and receive feedback.

Information collected from the internal review and public consultation processes will be considered by City Administration.  The application may then be approved, approved with conditions, or denied.

Following the Public Information Meeting on April 2nd, 2025, Planning and Development will prepare an Administrative Report for the application containing a summary of all feedback collected during the application review. The final decision to approve or deny this application rests with City Council, who will consider the report and recommendation at a Public Hearing. Any member of the public is welcome to provide a written submission or address City Council in person, regarding the application at the Public Hearing.
