Proposal
The Planning and Development Department has received an application from Camponi Housing Corporation (the applicant) proposing to amend the Zoning Agreement for 727 and 803 Hart Road.
Originally approved by City Council in 2020, the current Zoning Agreement provides for mixed-use development consisting of residential, institutional, and commercial uses, and includes regulations for site layout, building height and form, landscaping, and parking. The project is currently under development, and information can be found on the Engage Page for the original application (see Related Pages).
Application
The applicant has requested to modify the text of the Zoning Agreement to:
- Remove the vehicle parking space requirement for the development to provide flexibility by allowing Camponi Housing Corporation to determine how much parking to provide residents and other uses on the site. Accessible parking, loading spaces and bicycle parking spaces will be required to be substantially in compliance with the location and dimensions shown on the site plan;
- Increase the day care centre capacity from 30 to 70 persons;
- Add commercial schools, independent schools and medical clinics to the list of permitted uses; and
- Add regulations limiting the size of commercial schools and independent schools, and regulations for on-site waste space.
The Zoning Bylaw defines a commercial school as “a facility for training and instruction in a talent, skill or hobby and may include music, dance or similar school.”
An independent school is defined as “a facility which meets Provincial requirements for education or training and which does not secure the majority of its funding from taxation or any governmental agency and may include vocational schools.”
A medical clinic is defined as “a building or part of a building where two or more members of the medical profession, dentists, chiropractors, osteopaths or occupational therapists provide diagnosis and treatment to the general public without overnight accommodation and may include such uses as reception areas, offices, consultation rooms, x-ray facilities and minor operating rooms, providing that all such uses have access only from the interior of the building.”
A revised site plan of the applicant’s proposal shows the layout of the sites, including the buildings, outdoor play space for the day care centre, accessible parking spaces, bicycle parking, on-site waste and landscaping (see below).
