Zoning Bylaw Text Amendments - Primary Dwellings in Established Neighbourhoods and Garden and Garage Suites
Proposed amendments to Section 5.1.19 Primary Dwellings in Established Neighbourhoods
- A proposed amendment to increase the maximum front door sill height for primary dwellings in Category 1 Established Neighbourhoods from 1.0 metre to 1.3 metres above finished grade.
- Proposed amendments to the sidewall area regulations for primary dwellings in Established Neighbourhoods include:
- Clarifying the definition of sidewall
- Clarifying what is included and excluded in the calculation of allowable sidewall area
- Increasing the allowable sidewall area by 10%;
- Exempting portions of a sidewall that are set back more than 4.5 metres from the side property line; and
- Exempting facades facing a flanking street from the sidewall area calculation.
- Proposed amendments to Section 5.3.14 Garden and Garage Suites. An amendment to the garage suite regulations regarding the gross floor area of the 2nd storey.
REASON FOR THE AMENDMENT – The proposed amendments are intended to align the Bylaw No. 9990 - Zoning Bylaw, 2024, with the recommendations of the Infill Review Project.
Increasing the maximum front door sill height is intended to provide greater flexibility to address servicing constraints and basement design, including design options for secondary suites, while maintaining a relationship between the dwelling and the street.
The amendments to the sidewall area regulations are intended to clarify how sidewall area is calculated and reduce unintended building design constraints. Sidewall area controls would remain in place, and overall building scale would continue to be regulated through building height, setbacks and site coverage requirements.
The amendment to the garden and garage suite regulations will correct an error in a previous amending bylaw by reinstating the second-storey gross floor area requirement for garage suites.
